Nurse – Application for Travel Document (Advance Parole)

Definitions

“Applicant” is the foreign nurse

“Application” is the Application to for Travel Document

Application for Travel Document (Advance Parole)

If you depart the United States after the filing of an Application to Register Permanent Residence or Adjust Status with the Immigration and Naturalization Service without receiving advance permission to reenter it is considered an abandonment of the Application.  The District Director of an Immigration and Naturalization Service district office or an Immigration and Naturalization Service Regional Service Center may grant you advance permission to reenter if you have filed an Application to Register Permanent Residence or Adjust Status and you must leave the United States for a bona fide business or personal reason.  If you have filed an Application to Register Permanent Residence or Adjust Status advance parole will be granted for multiple entries for a one-year period.  If the Application to Register Permanent Residence or Adjust Status has not been adjudicated during the one-year period you may apply again for advance parole.

Filing Requirements

Once you have determined that you may adjust your status you file an Application to for Travel Document along with the Application to Register Permanent Residence or Adjust Status; three (3) photographs; and the filing fee with the Immigration and Naturalization Service Regional Service Center that has jurisdiction over the place where you reside.

Immigration and Naturalization Service Processing

Once the Immigration and Naturalization Service receives the Application, it will issue a Notice of Action (Receipt Notice) indicating the date of receipt; date of the notice; your name and address; and the approximate processing time of said Application.

Once the Application is approved by the Immigration and Naturalization Service, it will issue a second Notice of Action (Approval Notice) indicating the date of the notice; the date of the approval; your name and address and then will forward the travel document to you.

Immigration and Naturalization Service Processing Time

The processing time required differs depending on the Immigration and Naturalization Service Regional Service Center where the Petition is filed.  For the Immigration and Naturalization Service Regional Service Center processing times click here.
